FINDINGS OF FACT

RE: Frank and Mary Lowery
439 Conduit Drive
Mooresville, IN 46158

This matter came before the Mooresville Board of Zoning Appeals on

September 20, 1989, at 7:00 P.M. at the Mooresville Town Hall. The petition
requested a variance to reduce the rear setback from 40 feet to zero feet
on a .06 acre tract and lot #20 of Marleywood Estates First Section.

The Board of Zoning Appeals having heard evidence on the above captioned
petition, now makes the following findings of fact pursuant to I.C. 36-7-4-918.5:

1. That the approval of this variance from the development standards

would not be injurious to the public health, safety, morals, and general
welfare of the community due to the size of the lot in question and due to the
size to the lot adjoining a state highway and the elimination of one of the
current structures on a .06 of an acre.

2. That the use and value of the area adjacent to the property included

in the variance would not be affected in any substantially adverse manner
since the proposed structure would actually enhance the property and eliminate
the older structure which is an eyesore.

3. That the strict application of the terms of the zoning ordinance

would result in practical difficulties in the use of the property since

the .06 acre tract could not be used for any structure and meet the town

zoning requirements.

Chairman
