FINDINGS OF FACT <br /> <br />RE: Mark B. and Darla S. Robinson <br /> 6503 South White Lick Creek Road <br /> Indianapolis, IN 46231 <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br /> <br />September 20, 1989, at 7:00 P.M. at the Mooresville Town Hall. The petition <br />requested a variance from the Subdivision Control Ordinance in order to <br />build on 3.583 acres which was being set apart from their father's farm. <br /> <br />The Board of Zoning Appeals having heard evidence on the above captioned <br />petition, now makes the following findings of fact pursuant to I.C. 36-7-4-918.5: <br /> <br /> 1. That the approval of this variance from the development standards <br /> <br />would not be injurious to the public health, safety, morals, and general <br />welfare of the community due to the size of the lot in question and utilities <br />being provided along with proper access. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br /> <br />in the variance would not be affected in any substantially adverse manner. <br />That the adjoining property is a family owned farm and the residential use <br />would be consistent with it. That there are other residential uses in the <br />area not inconsistent with this. <br /> <br /> 3. That the strict application of the terms of the zoning ordinance <br /> <br />would result in practical difficulties in the use of the property due to <br /> <br />the ownership of the farm and the continued use of this property primarily <br /> <br />for agricultural uses. <br /> <br /> Chair{nan <br /> <br />Se~l~e~ary~ <br /> <br />Dated: <br /> <br /> <br />
