FINDINGS OF FACT <br /> <br /> RE: Myron Westenhofer <br /> 560 Bridge Street <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals <br />on January 20, 1988, at the regularly scheduled meeting date and <br />time. The Petition requested a variance from the development <br />standards of the front yard set-back from forty (40) feet to <br />ninteen (19) feet; rear twenty (20) feet to eight (8) feet, side <br />twenty (20) feet to ten (10) feet. <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence <br />on the above captioned petition now makes the following findings <br />of fact pursuant to I.C. 36-7-4-9-18.5: <br /> <br /> (1) The approval would not be injurious to the public <br />health, safety, morals and general welfare of the general <br />cormnunity in that this was consistent to other lots in the area <br />which were equally small. <br /> <br /> (2) That the use and value of the area adjacent to the <br />property included in the variance would not be affected in a <br />substantially adverse manner due to all of the lots in the area <br />being small. <br /> <br /> (3) That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use of <br />this property due to the size of the lots in the area and the <br />other business uses in the area. <br /> <br />Warren FrankliY~, Secretary <br />Dated: February /Z , 1988 <br /> <br /> <br />
