Re: <br /> <br /> FINDINGS OF FACT <br /> <br />Keith Hill and Lon Milburn <br />1119 North Indiana Street <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals <br />on January 20, 1988, at the regularly scheduled meeting date and <br />time. The petition requested a variance from the development <br />standards as to a planned unit development and the subdivision <br />control ordinance. <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence <br /> <br />on the above captioned petition now makes the following findings <br /> <br />of fac~ pursuant to I.C. 36-7-4-9-18.5: <br /> <br /> (1) That the approval would not be injurious to the public <br />health, safety, morals and general welfare of the community due <br />to the layout and size of the property involved. <br /> <br /> (2) That the use and value of the area adjacent to the property <br />included in the variance would not be affected in a substantially <br />adverse manner with the feeling that this use would only help <br />property values. <br /> <br /> (3) That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use of the <br />pmperty due to the layout of the ground. <br /> <br /> Findings of Fact on the subdivision issue: <br /> <br /> (1) That the approval would not be injurious to the public <br />health, safety, morals and general welfare of the community. <br /> <br /> (2) That the use and value of the area adjacent to the property <br /> included in the variance would not be affected in a substantially <br /> adverse manner due to the size of the lot and the layout of the lot. <br /> <br /> <br />
