front from forty (40) feet to nineteen (19) feet. There were no <br />remonstrators present. The board proceeded to findings of fact <br />and found that: <br /> <br /> (1) The approval would not be injurious to the public <br /> <br /> health, safety, morals and general welfare of the general <br /> community in that this was consistent to other lots in the area <br /> which were equally small. <br /> <br /> (2) That the use and value of the area adjacent to the <br /> property included in the variance would not be affected in a <br /> substantially adverse manner due to all of the lots in the area <br /> being small. <br /> <br /> (3) That the strict application of the terms of the zoning <br /> ordinance would result in practical difficulties in the use of <br /> this property due to the size of the lots in the area and the <br /> other business uses in the area. <br /> <br /> The Board then proceeded to unanimously approve the findings of <br /> fact and Tilford Bailey moved to grant the variance. This was <br /> seconded by Don Barry and unanimously passed. <br /> <br /> The next item to come before the Board was the variance request <br /> from the use standards filed by David Chandler and Judith Chandler <br /> of 45 East High Street to place a beauty shop. This was the <br /> location of Hair Fashions by J which was the site of two previous <br /> use variances for this same type of use. The Chandlers were present <br /> in person and by counsel, Mark Peden. Notices were in order and <br /> the petitioners proceeded to describe the use on the property. <br /> Petitioners advised that this structure had been used as a beauty <br /> shop for in excess of twelve (12) years and that they intended to <br /> <br />-2- <br /> <br /> <br />
