FINDINGS OF FACT <br /> <br />Re: Hardee's Food Systems, Inc. <br /> South Indiana Street <br /> <br /> This matter came before the Mooresville Board of Zoning <br />Appeals on March 16, 1988, at the regularly scheduled meeting <br />date and time. The petition requested a variance from the <br />development standards as to the set-back from ten (10) feet <br />zero (0) feet. <br /> <br />on <br /> <br />to <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence <br />the above captioned petition now makes the following findings <br />fact pursuant to I.C. 36-7-4-9-18.5: <br /> <br /> 1. The Board found that the approval would not be injurious <br /> <br />to the public health, safety, morals and general welfare of the <br />community due to the property in question being surrounded by <br />business usages which adjoin it on every side. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance would not be affected in a <br />substantially adverse manner due to the type of use of said area, <br />primarily the storage from Marathon, the Valley View parking areas <br />and entry way. <br /> <br /> 3.
