The petition requested <br />standards as to the back yard <br />fourteen (14) feet. <br /> <br />This matter came before the Mooresville Board of Zoning Appeals <br /> <br />February 17, 1988, at the regularly scheduled meeting date and <br /> a variance from the development <br /> set-back from forty (40) feet to <br /> <br /> The Mooresville Board of Zoning Appeals having heard <br />on the above captioned petition now makes the following <br />of fact pursuant to I.C. 36-7-4-9-18.5: <br /> <br /> (1) <br /> <br />to the public health, <br />community due to the <br />area. <br /> <br />evidence <br />findings <br /> <br />The Board found that the approval would not be injurious <br /> <br /> safety, morals and general welfare of the <br /> size of the lot and the development in the <br /> <br /> (2) That the use and value of the area adjacent to the property <br />included in the variance would not be affected in a substantially <br />adverse manner due to the size of the lot and the development of <br />the subdivision in general. <br /> <br /> (3) That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use of <br />the property due to the grade of the property and the location <br /> <br />of the septic system. <br /> <br />Warren Fra~klih,' ~ecretary <br /> <br />Dated: March~-,/f , 1988 <br /> <br />/S~eve Osc-hma~, Chairman <br /> <br /> <br />
