MINUTES OF THE MOORESVILLE BOARD OF ZONING APPE~J~S

The Mooresville Board of Zoning Appeals met at its regular
meeting place at the Mooresville Town Hall the 15th day of June,
1988. Present were board members Steve Oschman, Robert Tucker,
Tilford Bailey, Don Barry and Warren Franklin. The board's
attorney, Timothy C. Currens, was also present. The board
proceeded to determine a quorum was present and approved the
minutes of the prior meeting.

The first item to come before the board was the petition of
Gordon and Linda Esterline regarding the property located at the
southeast corner of Indiana and County Line Road. The Esterlines
were requesting a variance from the development standards on the
rear set-back from forty (40) feet to twenty and one half (20-1/2)
feet. The property is unimproved real estate with the petitioners
requesting the variance so they can sell the property to a party
to build on said real estate. A plot plan of the residence was
given to the board showing a proposed house of twenty-seven (27)
feet by fifty-two (52) feet. The board then opened the meeting up
to questions from the floor. Carolyn Osborne of 1215 North
Indiana Street, an adjoining property owner was there and
discussed water problems on the lot. Mrs. Osborne stated that if
the house was built the water that normally sits on that property
would be pushed over towards her house. Jeffrey Weedling of 47
East County Line Road raised the same issue. John Sheridan of
County Line Road also stated that there were water problems in the
area and, in particular, oD this lot.
