The board discussed this matter and, in particular, the water <br />problems and advised the parties that this was an issue as to the <br />findings of fact but that the board could not control this issue <br />and any request should be made to the town board or to the <br />Hendricks County Commissioners as to drainage problems along this <br />area. The board then discussed whether or not the addition of one <br />house to this water area would have any significant impact and <br />felt that it would not and it would be unfair to the property <br />owner. The board proceeded to findings of fact as follows: <br /> <br /> 1. That the approval would not be injurious to the public <br />health, safety, morals, and general welfare of the community due <br />to the location of the house and the size and location of the <br />house on the lot. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance would not be affected in a <br />substantially adverse manner in that the construction should <br />improve property values in this area. <br /> <br /> 3. That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the <br />development of this property due to the fact that it would be <br />difficult to construct any reasonable home on the lot that would <br />meet all set-back requirements. <br /> <br /> A motion was then made by Robert Tucker to approve the <br /> findings of fact and grant the variance as requested, this was <br /> seconded by Warren Franklin and unanimously carried. <br /> <br /> The next item to come before the board was the petition of <br /> Glenn E. and Carol Woolard on Lot 13 in Northpoint Subdivision <br /> <br />-¸2-- <br /> <br /> <br />
