RE:

Steven G. Beasley
Teresa J. Beasley
626 Kitchen Road

FINDINGS OF FACT

This matter came before the Mooresville Board of Zoning
Appeals on October 19, 1988, at the regularly scheduled meeting
date and time. The petition requested a variance for the
placement of a mobile home for temporary housing during the
construction of a new home on the property located at 540 Keller
Hill Road.

The Mooresville Board of Zoning Appeals having heard evidence
on the above captioned petition now makes the following findings
of fact pursuant to I.C. 36-7-4-9-18.5:

1. That the establishment, maintenance, and operation of the
Special Exception would not be detrimental to or endanger the
public health, safety, morals, or general welfare, since this use
was residential in nature.

2. That the Special Exception would be injurious to the use
and enjoyment of other properties in the immediate vicinity for
the purposes already permitted, due to the interference with the
enjoyment of the surrounding properties.

3. That the establishment of the Special Exception would
impede or substantially alter the normal and orderly development
and improvement of the surrounding property for uses permitted in
the district with the lowering of property values hurting proposed
development of surrounding ground.
