RE:

FINDINGS OF FACT

Paul D. Bryant
55 West Main Street

This matter came before the Mooresville Board of Zoning Appeals
on November 18, 1987, at the regularly scheduled meeting date and
time. The petition requested a variance from the use under the
Town's zoning ordinance.

The Mooresville Board of Zoning Appeals having heard evidence
on the above captioned petition now makes the following findings

of fact pursuant to I.C. 36-7-4-9-18.5:

(1) That the approval would not be injurious to the public
health, safety, morals and general welfare of the community in
that there were already similar types of uses in the area and the
type of business proposed would not be offensive.

(2) That the use and value of the area adjacent to the
property included in the variance will not be affected in a
substantially adverse manner due to the other similar uses in the
area.

(3) That the need for the variance arises from some
condition peculiar to the property involved in that it is located
in an area zoned residential, however, it is surrounded by other
business uses which put limitations on the use of the property as
residential.

(4) That the strict applications of the terms of the zoning
ordinance will constitute an unnecessary hardship if applied to
this property in that it will be difficult for the owner to use this
property strictly for residential purposes.

(5) That the approval does not interfere substantially with
the comprehensive plan adopted by the Civil Town of Mooresville in
