(2) That the use and value of the area adjacent to the <br />property included in the variance would not be affected in a <br />substantially adverse manner since there was no sign nor outward <br />sign of the business usage other than the van. <br /> <br /> (3) The board could not find that the variance arose from <br />any condition peculiar to the property. <br /> <br /> (4) The board found that the strict application of the terms <br />of the zoning ordinance would not constitute an unnecessary <br />hardship if applied to the property for which the variance was <br />sought. <br /> <br /> (5) That the approval does not interfere substantially with <br />the comprehensive plan. <br /> <br />The motion was then made by Don Barry to deny the variance for its <br />failure to meet all the criteria, in particular, finding number four <br />(4) regarding a hardship. Warren Franklin seconded this motion <br />and it unanimously carried. <br /> <br /> The next item to come before the board was the petition filed by <br />Stephen A. and Cheryl L. Edwards and Donald M. and Bobbi S. Barry <br />regarding Northpoint Subdivision, Lots 1, 3, 4, 5, 6, 7, 8, and 11 <br />requesting a variance from the development standards as to square <br />footage of lot size for B-multi-family residential. Mr. Barry <br />being an interested party in this matter withdrew from the board's <br />discussion. Since there was not a quroum present, the board <br />advised the parties that no new notices would be sent and set this <br />matter for a special meeting, Tuesday, December 1, 1987 at 7:00 <br />o'clock in the Town Court. All parties present were notified and <br />the board's attorney advised that Mr. Peasley should be sent a <br />letter since he had left early.
