to the public health, <br />community due to the <br />residential. <br /> <br /> FINDINGS OF FACT <br /> <br /> RE: June Harris <br /> 33 East Carlisle <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals <br />on August 19, 1987, at the regularly scheduled meeting date and time. <br />The petition requested a variance to allow for two family dwellings <br />on one lot. <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence <br />on the above captioned petition now makes the following findings <br />of fact pursuant to I.C. 36-7-4-19.4: <br /> <br /> 1. That the approval of this variance would not be injurious <br /> safety, morals and general welfare of the <br /> fact that the neighborhood is presently <br /> <br /> 2. The use and value of the area adjacent to the property <br />included in the variance will not be affected in a substantially <br />adverse manner in that there are currently apartments close by in <br />the neighborhood. <br /> <br /> 3. The need for the variance arises from some condition peculiar <br />to the property involved in that the apartment was orginally constructed <br />as a donut shoppe and if not allowed to be used as a residence, then <br />the property would have to be rezoned or a variance obtained for <br />allowing a business to operate on the property; <br /> <br /> 4. The strict application of the terms of the zoning ordinance <br />would constitute an unnecessary hardship if applied to the property <br />for which the variance is sought in that there are and have been <br />two buildings located on this one parcel of land; <br /> <br />5. The approval does not interfere substantially with the <br />comprehensive plan adopted by the Town of Mooresville in that the <br /> <br /> <br />
