MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS

The Mooresville Board of Zoning Appeals met at its regularly scheduled
meeting place, the Town Hall, on Wednesday, the 15th day of April, 1987.
Present were Board members Steve Oschman, Wendell Thaler, Tilford Bailey,
Donald Barry and Warren Franklin. The Board's Attorney, Timothy C. Cu~rens,
was also present. The meeting was called to order by Chairman Steve Oschman
who determined there was a quorum present. The Board then proceeded to approve
the minutes and findings of fact of the March meeting.

The first item on the agenda was the petition filed by Kenneth Wilcher

and Imogene Wilcher regarding the real property at 354 E. Washington Street,
Mooresville, Indiana. The Wilchers' request was to allow them to operate a
custom car care cleaning business in the garage located on the property. Mr.
Wilcher advised that all work would be done in the garage and consist of no
noise louder than a buffer. Healso explained that the house was over 100 feet
from the garage and the exact location of the area in the town. Mr. Wilcher
also advised that he would like some type of small sign to be positioned on the
garage itself. After a discussion by the Board the Chairman asked for findings
of fact. In discussion the Board found the following:

1. That the approval would not be injurious to the public health, safety,
morals and general welfare of the community in that this use was compatible with
the other businesses in the area and would take place on the interior of the
garage.

2. That the use and value of the area adjacent to the property included in
the variance would not be affected in a substantially adverse manner due to other
similiar business uses in that area and the proximity to the business area zoned
on Indainapolis Road and Main Street.

3. That the need for the variance arises from some condition peculiar

to the property involved, namely, the length of the lots and their location to

business uses.
