RE: <br /> <br /> FINDINGS OF FACT <br /> <br />Kenneth Wilcher and Imogene Wilcher <br />Property located at 354 E. Washington Street <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br />Wednesday, April 15, 1987, at the regularly scheduled meeting date and time. <br />The petition requested a variance to allow petitioners to operate a custom <br />car care cleaning business in the garage located on the property. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br /> <br />above captioned petition now makes the following findings of fact pursuant to <br />Indiana Code 3-7-4-918.4: <br /> <br /> 1. That the approval would not be injurious to the public health, <br /> <br />safety, morals and general welfare of the community in that this use was <br />compatible with the other businesses in the area and would take place on the <br />interior of the garage. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br /> <br /> in the variance would not be affected in a substantially adverse manner due to <br /> similiar business uses in that area and the proximity to the business area <br /> zoned on Indianapolis Road and Main Street. <br /> <br /> 3. That the need for the variance arises from some condition peculiar <br /> <br /> to the property involved, namely, the length of the lots and their location to <br /> business uses. <br /> <br /> 4. That the strict application of the terms of the zoning ordinance <br /> <br /> would constitute an unnecessary hardship if applied to the property for which <br /> the variance is sought due to the business uses in the area and the proximity <br /> to the same in light of the length of these lots and the alley access. <br /> <br /> 5. That the approval does not interfere substantially with the comprehensive <br /> plan due to the other business uses in the area and the access through the alley <br /> making this compatible. <br /> <br /> <br />
