RE:

FINDINGS OF FACT

Kenneth Wilcher and Imogene Wilcher
Property located at 354 E. Washington Street

This matter came before the Mooresville Board of Zoning Appeals on
Wednesday, April 15, 1987, at the regularly scheduled meeting date and time.
The petition requested a variance to allow petitioners to operate a custom
car care cleaning business in the garage located on the property.

The Mooresville Board of Zoning Appeals, having heard evidence on the

above captioned petition now makes the following findings of fact pursuant to
Indiana Code 3-7-4-918.4:

1. That the approval would not be injurious to the public health,

safety, morals and general welfare of the community in that this use was
compatible with the other businesses in the area and would take place on the
interior of the garage.

2. That the use and value of the area adjacent to the property included

in the variance would not be affected in a substantially adverse manner due to
similiar business uses in that area and the proximity to the business area
zoned on Indianapolis Road and Main Street.

3. That the need for the variance arises from some condition peculiar

to the property involved, namely, the length of the lots and their location to
business uses.

4. That the strict application of the terms of the zoning ordinance

would constitute an unnecessary hardship if applied to the property for which
the variance is sought due to the business uses in the area and the proximity
to the same in light of the length of these lots and the alley access.

5. That the approval does not interfere substantially with the comprehensive
plan due to the other business uses in the area and the access through the alley
making this compatible.
