FINDINGS OF FACT <br /> <br />RE: Gary & Betty Pryor, 903 Indiana Street <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br />Wednesday, March 18, 1987 at the regularly scheduled meeting date and time. <br />The petition requested a variance to place a part-time sales office for <br />swimming pools and supplies in the petitioner's garage. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br />above captioned petition now makes the following findings of fact pursuant to <br />Indiana Code 3-7-4-918.4: <br /> <br /> 1. That the approval of the variance would not be injurious to the <br />public health, safety, morals and general welfare of the community and that <br />due to the nature of the proposed business it should have little or no effect. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br />in the variance would not be affected in a substantially adverse manner due to <br />the low key nature of the business and all of it being conducted inside. <br /> <br /> 3. That the need for the variance arises from some condition peculiar <br />to the property involved, namely, that it is located on an arterial street which <br />has other home-type businesses. <br /> <br /> 4. That the strict application of the terms of the zoning ordinance will <br />constitute an unnecessary hardship if applied to the property for which the <br />variance is sought due to its location on an arterial street with similiar <br />type uses. <br /> <br /> 5. That the approval does not interfere substantially with the <br />comprehensive plan adopted by the Civil Town of Mooresville in that it is <br />compatible with other uses in the area. <br /> <br /> The Board also finds that the following restrictions are applicable <br /> <br />as part of the variance: <br /> <br /> 1o That there will be no outside storage. <br /> <br /> 2. That all parking will be on the Pryor's property. <br /> <br /> <br />
