FINDINGS OF FACT <br />Re: Labsonics, Inc. <br /> <br />This matter came before the Mooresville Board of Zoning Appeals on Tuesday, <br /> <br />January 27, 1987 at 7:00 p.m. The petition requested a variance of the <br /> <br />developmental standards to allow for the construction of a modular structure <br /> <br />to be used as temporary offices until the business can develop other property <br /> <br />which it has purchased. <br /> <br />The Board of Zoning Appeals, having heard evidence on the above captioned <br /> <br />petition now makes the following findings of fact pursuant to Indiana Code 36-7-4-918.5: <br /> <br />That the approval would not be injurious to the public health, <br />safety, morals and general welfare of the community since the <br />proposed variance is consistent with the present use of that <br />property. <br /> <br />2o <br /> <br />That the use and value of the area adjacent to the property <br />included in the variance will not be affected in a substantially <br />adverse manner in that all buildings on the west side of Bolton <br />Avenue encroach the property line so that the requested use is <br />consistent with the existing use in the area. <br /> <br />That the strict application of the terms of the zoning ordinance <br />will result in practical difficulties in the use of property in <br />that the existing building only has a 29' set back and the set backs <br />of all other homes in the area is not consistent with the zoning <br />ordinance and to require this temporary construction to meet the <br />set back requirements would be unreasonable given the fact that <br />non-compliance with the set back requirements is consistent in <br />the area. <br /> <br />Stey~ Oschman, Chairman <br /> <br />Da t ed: .-x~ '-],/~'/? ~ <br /> <br /> <br />
