Re: <br /> <br /> FINDINGS OF FACT <br />Variance Request by Theo Hastings <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br />Wednesday, December 17, 1986 at the regularly scheduled meeting date and time. <br />The petition requested a variance of the developmental standards to allow for <br />the placement of a garage on the property owned by Mr. Hastings. <br /> <br /> The Board of Zoning Appeals, having heard evidence on the above captioned <br />petition now makes the following findings of fact pursuant to Indiana Code <br />36-7-4-918.5: <br /> <br /> 1. That the approval would not injurious to the public health, safety, <br />morals and general welfare of the cormnunity since construction and placement <br />of garages are compatible with residential areas. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br /> <br />in the variance will not be affected in a substantially adverse manner and that <br />a private garage is a proper accessory use in an A district and the reduction of <br />the set back requirements will allow the placement of this private garage in a <br />manner most consistent with the location and appearance of the existing residence. <br /> <br /> 3. That the strict application of the terms of the zoning ordinance will <br />result in practical difficulties in the use of the property in that a variance <br />from the development standards would be required of any standard size garage no <br />matter where the garage is constructed on the lot and this property would be <br />denied the availability of a private garage which is an appropriate accessory <br />use in an A district. <br /> <br />St~ Oschman, Chairman <br /> <br />~ar~ren Franklin ,~S~'~r~-~ry ~ ~ - <br /> <br />Dated: January 21, 1987 <br /> <br /> <br />
