-3- <br /> <br />scheme and drainage and landscaping plans. The Board then opened this matter <br />up to questions from the floor. The administrator from Miller's Merry Manor <br />was present and had some questions regarding the location of the entry and <br />exit placements in relationship to Miller's Merry Manor. These questions <br />were answered and the next person to speak was Steve Edwards, who owns <br />approximately 7 pieces of property in the area. He felt that it would be an <br />asset to the community and was behind this 100%. <br /> <br /> There being no futher discussion from the floor the Board discussed <br />the variance in question and reviewed the findings of fact. The Board found <br />that the approval would not be injurious to the public health, safety, morals <br />and general welfare of the community and in fact felt this would be a great <br />asset to the community. (2) That the use and value of the area adjacent to <br />the property included in the variance would not be affected in a substantially <br />adverse manner, and that the structure should be an asset to the community and <br />the adjacent properties. (3) That the need for the variance arises from some <br />condition peculiar to the property involved due to the slope of the property and <br />the type of development that would be necessary to fully use this property being <br />limited to this type of structure versus breaking it down in residential areas <br />with the resulting drainage problems and portions of the ground that could not <br />be used. (4) That the strict application of the terms of the zoning ordinance <br />would constitute an unnecessary hardship if applied to the property for which <br />a variance is sought in that a local business classification would not be <br />compatible with the surrounding residential uses. (5) That the approval does <br />not interfere substantially with the comprehensive plan adopted under the Indiana <br />Code in that this is a compatible use with the prior location of the neighborhood <br />and proximity to schools and residential areas. The Board then entertained a <br />motion and Tilford Bailey moved to grant the variance. This was seconded by <br />Don Barry and Warren Franklin and the vote was unanimous. <br /> <br /> <br />
