MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at its regularly scheduled <br /> <br />meeting on Wednesday, the 19th day of March, 1986 at the Mooresville Town Hall. <br />Present were Board Members Steve Oschman, Tilford Bailey, Donald Barry, Warren <br />Franklin, and Wendell Thaler. The meeting was called to order by Chairman Steve <br />Oschman who determined that there was a quorum present. The Board's Attorney, <br />Timothy C. Currens, was also present. The Board then proceeded to approve the <br />minutes the of the prior meeting and findings of fact. <br /> <br /> The first item on the agenda was the continued petition of the Lamberts and <br /> <br />the Stephens, requesting a variance to place a mobile home on a residential property <br />along with a current mobile home. In particular, the variance from use as a mobile <br />home park and the variance from the special exception requirement for any mobile <br />home were requested along with variances from the development standard including <br />the sub-division control ordinance, lot set-back lines, square footage of the <br />home, lot size, and side set-backs. Pictures were introduced by Mr. Stovall, <br />the attorney representing the petitioners, who went on to describe other uses in <br />the area and he pointed out the location of other mobile homes. Mrs. Stephens stated <br />that it was not their intention to put anything in the area that would depreciate <br />the value of the home since they had a current rental on this same property. Board <br />Member Wendell Thaler had a question regarding the 78 foot distance from the home <br />to the alley and the distance between the respective mobile homes on the property. <br /> <br /> The petitioners rested and Robert Lybrook, representing one of the remonstrators, <br />stated that nothing had changed since the initial hearing and there was no hardship <br />shown as required under the law. He further stated that the purchasers had recently <br />entered into the agreement for this property so they were aware of the zoning and <br />any potential problem with the mobile home location prior to the purchase. Mr. <br />Lybrook stated that the request as set out would have the Board rewrite the ordinance <br /> <br /> <br />
