FINDINGS OF FACT <br />RE: Request of Patricia Duncan <br /> 425 E. St. Clair Street <br /> Mooresville, IN 46]58 <br /> <br /> This matter came before the Mooresv~lle Board of Zoning Appeals on <br /> <br />Wednesday, March 19, 1086, at the regularly scheduled meeting date and time. <br />The petition requested a variance from the development standards, including the <br />sub-d~vision control ordinance, set-backs on the front and rear side, mobile <br />home special exception. <br /> <br /> The MooresvJlle Bomrd of Zoning Appesls having heard evidence on the abo~e <br />c~pt~oned petition now makes the following findings of fact pursuant to Indians <br />Code 36-7-4-918.5: <br /> <br /> ]. That the approval of tha variance from the sub-division control ordimance, <br />the set-backs and the mobile home special exception procedure would not be injurious <br />to the public health, safety, morals and genera], welfare of the community in light of <br />other housing in the area and the fact that there had been a prior home located on <br />this ground. <br /> <br /> 2. That bhe use and value of the area mdjacent to the property included <br /> <br />Jn the varimnce would out be affected in s substantially adverse ~anner by the <br />v~riance as granted due to the fact that a prior home hsd been on this proper~y <br />and that the proposed home would be an improvement to the home which had burned. <br /> <br /> 3. That the strict application of the terms of the zoning ordinance <br /> <br /> would result in prsctJca] difficulties in the ~se of the property since the <br /> destruction of the prior home which bad been a proper use prior to the current ordinance <br /> would make it difficult to return the land to ~ts prior use. <br /> <br />~ S~c~.tary <br /> <br />St ev~ Oschman, ChaJ rm~n <br /> <br /> <br />
