FINDINGS OF FACT
RE: Request of Patricia Duncan
425 E. St. Clair Street
Mooresville, IN 46]58

This matter came before the Mooresv~lle Board of Zoning Appeals on

Wednesday, March 19, 1086, at the regularly scheduled meeting date and time.
The petition requested a variance from the development standards, including the
sub-d~vision control ordinance, set-backs on the front and rear side, mobile
home special exception.

The MooresvJlle Bomrd of Zoning Appesls having heard evidence on the abo~e
c~pt~oned petition now makes the following findings of fact pursuant to Indians
Code 36-7-4-918.5:

]. That the approval of tha variance from the sub-division control ordimance,
the set-backs and the mobile home special exception procedure would not be injurious
to the public health, safety, morals and genera], welfare of the community in light of
other housing in the area and the fact that there had been a prior home located on
this ground.

2. That bhe use and value of the area mdjacent to the property included

Jn the varimnce would out be affected in s substantially adverse ~anner by the
v~riance as granted due to the fact that a prior home hsd been on this proper~y
and that the proposed home would be an improvement to the home which had burned.

3. That the strict application of the terms of the zoning ordinance

would result in prsctJca] difficulties in the ~se of the property since the
destruction of the prior home which bad been a proper use prior to the current ordinance
would make it difficult to return the land to ~ts prior use.

~ S~c~.tary

St ev~ Oschman, ChaJ rm~n
