Hastep and Mark Hasten <br /> <br /> a.d Taco Bell Corporation <br /> <br /> This matter came before the Mooreoville Board of Zoning Appeals on <br />Wednesday, March 19, 1986, at the regularly scheduled meeting date and time. <br />The petitien requested a variance from the development standards requiring <br />approval of a s,~b-d~vigion of land by the Plan Commission, pursuapt to the <br />sub-division control ordinance. <br /> <br /> The MooresvJlle Board of Zoning Appesls, having heard evidence on the <br />above captioned petitio~ now mares the following findings of fact pursuant to <br />Indiana Code 36-7-4-9!8.5: <br /> <br /> 1. That the approval of the variance woold not be injurious to the public <br />health, safety~ morals, and general welfare of the community in that the site <br />plan as presented was up to the ordinance standards and the fnrc~ng of this matter <br />to the Plan Commission did not result in any major changes which would affect <br />the general well-be~ng of tbe community. <br /> <br /> 2. That the use ~nd value o£ the area adjacent to the property included <br />in the variance would not be affected in s substantially adverse ~an~er by the <br />granting of this variance~ in that the site plan was set out in confmrm~ty with <br />ordinance standards end crdinapce standards would have to be complied with prior <br />to any building permit being obtained. <br /> <br /> 3. That the strict application of the terms of bhe zoning ordinance wonld <br />result ~n practical difficulties in the use of the property in that additional <br />meetings wonld have to be held and unnecessary delays incurred al! interfering with <br />the development of said property. <br /> <br /> <br />
