FINDINGS OF FACT <br />Mooresville Board of Zoning Appeals <br />Re: Variance Request of Harlan & Ruth Sterrett <br /> 1021 State Road 144, Mooresville, IN 46158 <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br />Wednesday, February 19, 1986, at the regularly scheduled meeting date and time. <br />The petition requested a variance from the zoning ordinance, in particular, <br />the request was to locate a sign on the premises. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br />above captioned petition now makes the following findings of fact pursuant to <br />Indiana Code 36-7-4-918.5: <br /> <br /> 1. That the approval would not be injurious to the public health, <br />safety, morals, and general welfare of the connnunity due to the type of business <br />located on the premises and the limited amount of business that should take place. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br /> in the variance would be affected in a substantially adverse manner in that a <br /> sign in a residential area would change the character of the surrounding uses <br /> affecting the residential use and property values associated with strictly a <br /> residential use versus a residential use mixed with a commercial use by allowing <br /> the outward display of the business use with a sign. <br /> <br /> 3. That the strict application of the terms of the zoning ordinance would <br /> not particularly result in any practical difficulties in the use of the property <br /> in question in that there has been no showing that this property is distinct from <br /> any other property for the use requested. <br /> <br /> , Secretary <br /> <br />Dated: <br /> <br /> <br />
