FINDINGS OF FACT
Mooresville Board of Zoning Appeals
Re: Variance Request of Harlan & Ruth Sterrett
1021 State Road 144, Mooresville, IN 46158

This matter came before the Mooresville Board of Zoning Appeals on
Wednesday, February 19, 1986, at the regularly scheduled meeting date and time.
The petition requested a variance from the zoning ordinance, in particular,
the request was to locate a sign on the premises.

The Mooresville Board of Zoning Appeals, having heard evidence on the
above captioned petition now makes the following findings of fact pursuant to
Indiana Code 36-7-4-918.5:

1. That the approval would not be injurious to the public health,
safety, morals, and general welfare of the connnunity due to the type of business
located on the premises and the limited amount of business that should take place.

2. That the use and value of the area adjacent to the property included
in the variance would be affected in a substantially adverse manner in that a
sign in a residential area would change the character of the surrounding uses
affecting the residential use and property values associated with strictly a
residential use versus a residential use mixed with a commercial use by allowing
the outward display of the business use with a sign.

3. That the strict application of the terms of the zoning ordinance would
not particularly result in any practical difficulties in the use of the property
in question in that there has been no showing that this property is distinct from
any other property for the use requested.

, Secretary

Dated:
