-7-

might be a safety factor regarding the business location off the highway.

The Board then proceeded to a discussion of the variance from development
standards and Wendell Thaler stated that at the first meeting although counsel

Sam Korn did not speak well due to laryngitis, they did initiate a compromise
allowing the business contingent upon no advertising. That since that date
there has been a sign present repeatedly and believes a sign would decrease
property values. The Board further discussed the development standards finding
that the approval would not be necessarily injurious to the public health, safety,
morals or general welfare of the community. They found that the use and value of
the area adjacent to the property included in the variance would be affected in
a substantially adverse manner in that in this residential area property values
would be affected, injuring the adjacent property owners. The Board found that
the strict application of the terms of the zoning ordinance would not particularly
result in any practical difficulties in the use of the property in question.

The Chairman then entertained a motion from the floor and at this time Attorney
Stovall requested a continuance to determine an alternate sign or evidence on
property values. Steve Oschman again opened this up to the Board and Tilford
Bailey made a motion to deny the request for a variance and not to continue the
matter. This was seconded by Don Barry and unanimously passed. There being
no further business to come before the Board the meeting was adjourned upon
motion duly made, seconded and unanimously carried.

St~ Oschman, L~airman

, Secretary
