FI~INGS OF FACT OF THE MOO~SVILLE BOARD OF ZONING ~PEALS <br /> <br />Harlan B. Sterrett <br />1021 State Road 144 <br />Mooresville, IN <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br /> <br />August 21, 1985 at the regularly scheduled meeting date and time. The petition <br />requested a variance from the use standards. In particular the request was to <br />allow an advertising sign on the residential property owned by petitioners. The <br />Mooresville Board of Zoning Appeals, having heard evidence on the above captioned <br />petition now makes the following findings of fact pursuant to Indiana Code 36-7-4-918.4: <br /> <br /> 1. That the approval would be injurious to the public health, safety, <br />morals and general welfare of the community in that it creates a potential safety <br />traffic hazard in the vicinity. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br /> <br />in the variance would be affected in a substantially adverse manner by the open <br /> <br />and obvious nature of the advertising sign in this residential area. <br /> <br /> 3. That the need for the variance does not arise from some condition <br />peculiar to this property. <br /> <br /> 4. That the strict application of the terms of the zoning ordinance would <br />not constitute an unnecessary hardship if applied to the property for which a <br />variance is sought. <br /> <br /> 5.
