FINDINGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />James K. Vinton and Connie Vinton <br />401 S. Indiana Street <br />Mooresville, Indiana <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br />Wednesday, August 21, 1985, at the regularly scheduled meeting date and time. <br />The petition requested a variance from the development standards on the property <br />located at 401 South Indiana Street. In particular, the request was to allow <br />a set-back of zero feet from the ordinance requirement of ten feet for said <br />property. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br />above captioned petition, now makes the following findings of fact pursuant to <br />Indiana Code 36-7-4-918.5: <br /> <br /> 1. That the approval will not be injurious to the public health, <br />safety, morals and general welfare of the community in that said set-back is <br />adjacent to an alley and a dropoff which would not in any way create any type <br />of public health or safety problem. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br />in the variance will not be affected in a substantially adverse manner in that <br />due to the alleyway and the property adjacent being substantially lower this <br />should not affect this property in any manner. <br /> <br /> 3. That the strict application of the terms of the zoning ordinance will <br />result in practical difficulties in the use of the property in that due to the <br />dropoff of approximately eight feet to the adjacent property this property cannot <br />be developed normally without this variance. <br /> <br />~arren Franklin, S-~cretary <br /> <br />St~v'e 0schman, Chairman <br /> <br /> <br />
