will not be injurious to the public health, safety, morals and general welfare <br />of the community would not be met. In addition he stated there could be <br />problems with safety in the dead end and turn around area. The Board then <br />proceeded to make a finding that items one through three of the variance for <br />use under Indiana Code 36-7-4-918.4 were not met. Chairman Oschman entertained <br />a motion. The motion was made by Wendell Thaler to deny the variance based upon <br />its failure to meet the criteria under Indiana Code items one and two for the <br />reasons discussed. Tilford Bailey seconded and the Board unanimously denied <br />the variance petition. <br /> <br /> The Board then proceeded to Variance No. 3-1985 filed by Harlan Sterrett <br />and Ruth V. Sterrett who reside at 1021 State Road 144, Mooresville, Indiana. <br />Attorney Currens found the certified letters and newspaper notice to be in order. <br />Mr. Sterrett was present in person and by counsel, Sam Korn. Attorney Korn <br />proceeded to advise the Board that this area was zoned residential and was <br />located directly across the drive from Neil Armstrong School. Steve Oschman <br />then proceeded to ask some questions of Mr. Sterrett. Mr. 8terrett stated that <br />he had done some C.B. and radio repair in the home over a period of time and <br />it was a combination hobby and business. He stated that on some days he would <br />have no customers and on other days two or three. He further stated that it <br />was not a sufficient business to make a living but since he is legally blind <br />and always around the home that this was a good way for him to spend his time. <br />He also advised that his wife helps by doing soldering and that this business <br />was an outgrowth from their C.B. club which they have been active in for <br />approximately five years. He stated that his customers came primarily from <br />Mooresville and Martinsville and would drop things off and pick them up later, <br />rarely staying any great period of time. Also that it was a rarity for more <br />than two cars to be present. Mr. Sterrett stated there was room in his drive <br />for the cars to turn around and that backing out was somewhat dangerous. He <br />felt there was no parking problem or highway parking, no noise and stated that <br /> <br />-3- <br /> <br /> <br />
