FINDINGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEALS
In Re: Variance Application 5-1984
CenturY 21-Arnold & Associates
7 West High Street, Mooresville, Indiana

This matter came before the Board of Zoning Appeals on April 18, 1984
requesting a variance from the use ordinance of the Civil Town of Mooresville.

The Mooresville Board of Zoning Appeals having heard evidence on the above captioned
petition now makes the following findings of fact pursuant to Indiana Code 36-7-4-918.4:

1. That there are exceptional and extraordinary circumstances
or conditions applicable to the property of the petitioners
and to the intended use that does not apply generally to the
other property or class of use in the same vicinity and in the
district in which it is located. Primarily that this property
is located on the border of a residential area making it a good
buffer between business and residential with the use granted
by this variance.

2. That the variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and district if such variance was
not granted. In particular the properties adjoining Indiana
Street with business uses.

3. That the granting of such variance will not be materially
detrimental to the public welfare or injurious to the property or
improvements in the vicinity and district in which the subject
property is located. In particular there are several adjoining
business interest on Indiana Street which are zoned business and
the location of this property makes it a good buffer to the
surrounding residential areas on High Street.

4. That granting of such variance will not alter the land use
