FINDINGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEALS <br />In Re: Variance Application 5-1984 <br />CenturY 21-Arnold & Associates <br />7 West High Street, Mooresville, Indiana <br /> <br /> This matter came before the Board of Zoning Appeals on April 18, 1984 <br />requesting a variance from the use ordinance of the Civil Town of Mooresville. <br /> <br />The Mooresville Board of Zoning Appeals having heard evidence on the above captioned <br />petition now makes the following findings of fact pursuant to Indiana Code 36-7-4-918.4: <br /> <br /> 1. That there are exceptional and extraordinary circumstances <br /> or conditions applicable to the property of the petitioners <br /> and to the intended use that does not apply generally to the <br /> other property or class of use in the same vicinity and in the <br /> district in which it is located. Primarily that this property <br /> is located on the border of a residential area making it a good <br /> buffer between business and residential with the use granted <br /> by this variance. <br /> <br /> 2. That the variance is necessary for the preservation and <br /> enjoyment of a substantial property right possessed by other <br /> property in the same vicinity and district if such variance was <br /> not granted. In particular the properties adjoining Indiana <br /> Street with business uses. <br /> <br /> 3. That the granting of such variance will not be materially <br /> detrimental to the public welfare or injurious to the property or <br /> improvements in the vicinity and district in which the subject <br /> property is located. In particular there are several adjoining <br /> business interest on Indiana Street which are zoned business and <br /> the location of this property makes it a good buffer to the <br /> surrounding residential areas on High Street. <br /> <br /> 4. That granting of such variance will not alter the land use <br /> <br /> <br />
