FINDINGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />Re: <br /> <br />Variance Application of C. Sue Rodgers, 45 E. High <br />Street, Mooresville, Indianm. This ~atter came <br />before the Board of Zoning Appeals on June 20, 1984 <br />requesting a variance from the use ordinance of <br />the Civil Tovzn of Mooresville to operate a beauty <br />shop. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br /> <br />above captioned petition now makes the following findings of fact pursuant <br /> <br />to I.C. 36-7-4-918.4: <br /> <br /> 1. That there are exceptional and extraordinary circumstances or conditions <br />applicable to the property of the petitioners and to the intended use that does <br />not apply generally to other property or class of use in the same vicinity and <br />in the district in which it is located. In particular that this property is <br />currently being operated under a variance for the same use and has since 1982 <br />without problem. <br /> <br /> 2. That the variance is necessary for the preservation and enjoyment of <br /> <br />a substantial property right possessed by other property in the same vicinity <br />and district if such variance was not granted. That several properties in this <br />area are rezoned business and the continued use of this property as a business <br />is necessary to preserve and enjoy all substantial property rights possessed <br />within the same ~reas by this landowner. <br /> <br /> 3. That the granting of such variance will not be materially detrimental <br />to the public welfare or injurious to the property or improvements in the vicinity <br />or district ~n which the subject property is locsted. In particular, the use <br />of this property will not be changed from its current use and will not materially <br />affect any of the adjoining property owners nor property values. <br /> <br /> 4. That the granting of such variance will not alter the land use <br />characteristics of the vicinity and the district in which such property is located <br />or diminish the marketable value of adjacent land and the improvements or cause <br />or add to additional traffic congestion to the public streets in the area where <br />the improvements are to be made in accordance with the granting of the variance. <br />In particular that since this property has continued to operate as a beauty shop <br />in the past it will not greatly affect or diminish any property values and will <br />merely be keeping the status quo. <br /> <br />/~arren F~ankli~., Sec'r&tary <br /> <br /> Dated: 7-- <br /> <br />Steve 0scPm~an, Chairman <br /> <br /> <br />
