FINDINGS OF FACT OF THE MOORESVILLE B~ARD OF ZONING APPEALS <br /> <br />Re: <br /> <br />Variance Application of William & Margie Wright, 238 E. <br />Harrison Street. This is a petition for a variance <br />from the use standards coming before the Mooresville <br />Board of Zoning Appeals requesting conversion of the <br />garage into a rental with a family dwelling and <br />carport. <br /> <br /> The Mooresvil!e Board of Zoning Appeals having heard evidence on the <br /> <br />above captioned petition now mRkes the following findings cf fact pursuant to <br />Indiana Code 36-7-4-918.4: <br /> <br /> 1. That there are exceptional and extraordinary circumstances or conditions <br />applicable to the property of the petitioners and to the ~nt~nded use that does <br />not apply general]y to other property or clams of ~se in the same vicinity a~d <br />in the distr~ct ~n which it ~s located~ In particular the lot size and location <br />of str~ct,~res making it s reasonable uee for expansion as a rental property <br /> <br /> ?. That the variance is necessary for the preservatio~ and enjoyment of <br /> <br />a substmnt~al property r~ght possessed by other property in the same vicinity <br />and district if such variance wam not granted. In particular, that adjoining <br />properties in the area have similiar uses. <br /> <br /> 3~ That the granting of such variance will not be materially detrimental <br /> <br />to the public welfare or injurious to the property or improvements in the vicinity <br />or district in which the subject property is located. In particular, several <br />adjoining areas have rental lecations on the same lot and similiar uses. <br /> <br /> 4. That the granting of such variance will net alter the land use <br /> characteristics of the vicinity and the district in which such property is located <br /> or diminish the marketable value of adjacent land and the improvements or cause <br /> or add t~ additional traffic congestion to the public streets in the area where <br /> the ~mprovements are to be made in accordance with the granting of the variance° <br /> <br /> In particular this area and use will not have additional traffic of any significance <br /> nor will this in any way diminish the value of adjacent properties or change the <br /> character of the vicinity. <br /> <br />~.a~/r ~n~' ~/'~~-~ ~. <br />Dated <br /> <br />St~fe Oschman, Chairman <br /> <br /> <br />
