FINDINGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />~e: Nancy Harris, 5q S. Clay Street, Meoresville, Indiana <br /> <br /> This matter came before the Beard of 7oning Appeals on Wednesday, July 18, <br />1984. The request for variance w~s on the set-back requirements in the rear <br />from 40 feet to ]4 faet and the side from 12 feet te 10 feet. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br />above captioned petition mow makes the following findings of fact pursuant to <br />Indiana Code 36-7-4-918.5: <br /> <br /> 1. That the approval of this variance from the development standard~ <br />will not bm injurious to the public health, safety, morals and general welfare <br />of the community; in that the current set backs are similar to the variapce <br />proposed and the whole ar~a is fenced. <br /> <br /> 2. The use and v~lue of the area adjacent to the property included in <br />the variance will not be affected in a substantially adverse manner and in fact <br />said property value should be increased by the overall improvements proposed. <br /> <br /> 3. The strict application of the terms of th~ zoning ordinance will result <br />in practical difficulties in the use of the property.
