FINDINC, S OF FACT OF THE MOORESVI!LE BOARD OF ZONING APPEALS <br /> <br />RE: Petition of Donald Ray Bryson and Susan Ann Bryson <br /> 31Devonwood Drive, Mooresv~lle, IN <br /> <br /> This matter came before the Board of Zoning Appeals on Wednesday, the <br /> <br />15th day of August, 1984. The request for variance was regarding the development <br />standards as to the rear and side set backs requesting a variance on the side from <br />12 feet to 6 feet and in the rear from 40 feet to 6 feet. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the above <br />captioned petition now makes the following findings of fact pursuant to Indiana <br />Code 36-7-4-918.5: <br /> <br /> 1. That the approval of this variance from the development standards will <br />not be inj~rious to the p,bl~c health, safety, morals and general welfare of <br />the community; ~n that the location of similar side and rear set backs for such <br />structures Js common in the area proposed and the general community. <br /> <br /> 2. The use and value of thc area adjacent to the property included in the <br />variance will not be affected in a substantially adverse manner and in fact said <br />property value should not be affected at all in that the location of said storage <br />sheds in the area is co~on. <br /> <br /> 3. The strict application of the terms of the zoning ordinance will result <br /> in practical difficulties in the use of the property.
