FINDINGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEALS <br />Re: <br /> <br />W.P. Wingler, Country Corner Furniture, at the intersection <br />of State Road 67 and Allison Road, Lot No. 1, Wendell Duncan's <br />Sugarwood Subdivision. <br /> <br /> This matter came before thc Board of Zoning Appeals on August 18, 1984. <br />Thc petitioner was requesting a variance from the development standards in <br />particular the front set back from 50 feet to 42 feet. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br />above captioned petition now makes the fo]lowing findings of fact pursuant to <br />Indiana Code 36-7-4-918.5: <br /> <br /> l. That the approval of th~s variance from the development standards will <br />not be injurious to the public health, safety, morals or general welfare of the <br />community. The Bosrd found after reviewing the facts that this is not in a <br />residential area and is adjacent to a business use which it will be a part of <br />and would in no way affect the genera] public health, safety, morals or general <br />welfare of the community. <br /> <br /> 2. The use and value of the area adjacent to the property included in the <br />variance will not be affected in a substantially adverse manmer. The surrounding <br />uses will not be affected by this proposed structure and the permanent storage <br />will enhance the surrounding area. <br /> <br /> 3. The strict application of the terms of the zoning ordinance will result <br />in practical difficulties in the use of the property but in particulor, due to a <br />telephone company easement the atructure could not be built ~n l~ne with the <br />existing structures without the granting of the variance as requested. <br /> <br />~T~r~r{ Fr-a~m~lin, 'Secretary <br /> <br /> Dated: <br /> <br /> <br />
