MOORESVILLE BOARD OF ZONING APPEALS
FINDINGS OF FACT

The Mooresville Board of Zoning Appeals reviewed the Variance

Request of Environmental Development Corporation at its meeting of

December 16th, ]992, concerning the setbacks on Lots 97, 98, 99,

]00, and 101, and the reduced setback building lines on Lots 316,

117, 118, 119, 120, 121, and 122; and the reduced frontage on Lots

98, 99, 100, 121, and 122, all of Rooker Trace Subdivision,

Section IV, and the Board now makes the following findings of fact

pursuant to I.C. 36-7-4-918.5:

1. That the approval of the variance of the setbacks and
building lines along with reduced road frontage would not be
injurious to the public health, safety, morals and general welfare
of the community due to the fact that the detention basin and cul
de sac and contour of the gound affect each of these requests in a
manner as to not create any harm to the general welfare.

2. That the use and value of the area adjacent to the
property included in the variance will not be affected in a
substantially adverse manner due to the contour of the ground and
the drainage.

3. That the strict application of the terms of the Zoning
Ordinance would result in practical difficulties in the use of the
property, more particularly, in reasonable development of the
ground, unused drainage areas and wasted ground.

MOORESVILLE BOARD OF ZONING APPEALS

Date:

Charles McGuire, Chairman
~ernon Kim~el~,~Z~cretary
