MOORESVILLE BOARD OF ZONING APPEALS
FINDING OF FACT

The Mooresville Board of Zoning Appeals having reviewed the

Variance Request from the length-width ratio and the front setback

lines requesting a variance from 40' to 25' on the Minor Plat of

Eugene D. Perry and Barbara J. Perry at its December 16, 1992,

meeting now makes the following findings pursuant to I.C. 36-7-4-

918.5:

1. That the approval of the variance would not be injurious
to the public health, safety, morals, and general welfare of the
community due to the fact that the private drive disects the
properties allowing for additional length and minor traffic as to
the setbacks.

2. That the use and value of the area adjacent to the
property, including the variance will not be affected in a
substantially adverse manner due to the contour of this ground in
the Minor Plat.

3. That the strict application of the terms of the Zoning
Ordinance would result in practical difficulties in the use of the
ground, more particularly, the development of the ground in a
reasonable manner.

MOORESVILLLE BOARD OF ZONING APPEALS

Date:

Charles -Mc~uire [ ~Chairman
~r n~V-~im~ 1, ~cretary ~
