FINDINGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />RE: <br /> <br />Petition of Mooresville Federal Savings and Loan <br />on Real Estate located at 24 Springmill Court <br />Mooresville, Indiana <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on the <br />17th day of October, 1984, at the regular scheduled meeting. The petition re- <br />quested a variance from the development standards, in particular the setback <br />requirements for a 3 1/2 foot by 8 foot identification sign. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br />above captioned petition, now makes the following findings of fact pursuant to <br />Indiana Code 36-7-4-918.5: <br /> <br /> 1. That the approval of this variance from the development standards <br />will not be injurious to the public health, safety, morals or general welfare <br />of the community. That, in particular, the neighborhood has several other signs <br />with similar setbacks and the sign itself does not block the view from the road <br />for any of the traffic. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br />in the variance, will not be affected in a substantially adverse manner. That <br />in this case the sign does not affect any of the adjoining property uses. <br /> <br /> 3. That the strict application of the terms of the zoning ordinance will <br />result in practical difficulties in the use of the property. That in this case <br />there is a similar sign with the same type of setback and it would be better for <br />the signs to be placed in the same manner. <br /> <br />Warren Franklin, Secretary <br /> <br /> <br />
