FINDINGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />RE: <br /> <br />Jerry L. and Terri R. Taylor <br />830 Edgewood Drive <br />Mooresville, Indiana <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on the <br /> <br />17th day of October, 1984, at the regular scheduled meeting. The petition re- <br />quested a variance from the development standards, in particular the setbacks <br />on the side and rear from 12 foot on the side to 4 feet and 40 feet to 16 feet <br />in the rear to put in a garage. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br /> <br />above captioned petition, now makes the following findings of fact pursuant to <br />Indiana Code 36-7-4-918.5: <br /> <br /> 1. That the approval of this variance from the development standards will <br />not be injurious to the public health, safety, morals or general welfare of the <br />community. That in particular, the neighborhood has several other residences <br />with similar setbacks for their garages and the construction as proposed should <br />in no way have any affect on the general public health, safety, morals or general <br />welfare of the community. <br /> <br /> 2. That the use and value of the area adjacent to the property included in <br />the variance, will not be affected in a substantially adverse manner. Due to the <br />construction in the neighborhood of many other garages which are less than the <br /> <br />12 foot side setback and 40 foot rear setback, the proposed construction should have <br />not affect on any of the adjacent properties. <br /> <br /> 3. The strict application of the terms of the zoning ordinance will result <br />in practical difficulties in the use of the property. In particular, the property <br />could not be expanded for any normal residential use or other structures if the <br />strict application of the setbacks were applied. <br /> <br />Warren Franklin, Secretary <br /> <br /> <br />
