FINDINGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />RE: <br /> <br />R. Alan McConnell <br />Property in buffer zone off State Road 267 <br />North of Mooresville, Indiana <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br />Wednesday, December 19, 1984, at the regularly scheduled meeting date and <br />time. The petition requested a variance from the use standards of the property <br />described in the attached legal description to the petition. In particular, <br />the request was to allow the placement of a mobile home on said real property <br />for a period of five (5) years to be used as a personal residence by R. Alan <br />McConnell. The request also was for a variance from the development standards <br />on said property to allow the mobile home to be placed on said property without <br />a permanent foundation and concrete footings. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br />above captioned petition, now makes the following findings of fact pursuant to <br />Indiana Code 36-7-4-918.4: <br /> <br /> 1. That the approval will not be injurious to the public health, safety, <br />morals, and general welfare of the cormnunity in that said mobile home should not <br />affect any of the surrounding area, it being located on 7.65 acres of ground <br />and Mr. McConnell does own other ground in the area. <br /> <br /> 2. The use and value of the area adjacent to the property included in the <br />variance will not be affected in a substantially adverse manner in that Mr. <br />McConnell owns surrounding ground and the mobile home will be for a limited use <br />of five (5) years. <br /> <br /> 3. The need for the variance arises from some condition peculiar to the <br />property involved in that said property is not located near city sewers or <br />streets and construction will take some period of time for completion. <br /> <br /> 4. That strict application of the terms of the zoning ordinance will <br />constitute an unnecessary hardship if applied to the property for which the <br />variance is sought in that the special exception for a mobile home would require <br />a permanent special exception for that use versus the limited five-year use <br />granted. <br /> <br /> 5. The approval does not interfere substantially with the comprehensive <br /> plan adopted under the 500 series of this chapter of the Indiana Code in that <br /> the use will continue to be substantially residentual, single family dwelling. <br /> <br /> <br />
