MINUTES OF MOORESVILLE BOARD OF ZONING APPEALS

The Mooresville Board of Zoning Appeals met in a specially called session
on Wednesday, the 23rd day of February, 1983 at 7:00 o'clock P.M. at the
Mooresville Town Hall. Present were Board Members Steve Oschman, Paul Walters,
Nan Kollmeyer, Wendell Thaler, and the Board's Attorney, Tim Currens. The
meeting was called to order by Chairman Steve Oschman and minutes of the last
meeting were read and approved by all members. Determination of a quorum was
made and the Board proceeded to the first item of business, zoning appeals
docket number 1-83, a petition for variance filed by Pearl Meyer of 266 E.
South Street, Mooresville, Indiana requesting a variance for the purpose of
establishing a real estate office at the 266 E. South Street address which
is zoned residential. Bill Swinney, Mrs. Meyer's son was present to present
the request and advised the Board that he was interested in opening his office
and having Mrs. Meyer assist him at that location which is her residence. He
advised the Board that a sign would be placed in front of the property and
routine real estate business would be transacted. There were no questions
from the floor and Mr. Swinney explained the exact location of the properties
and surrounding properties to Board Members on the plot plan presented. Board
Attorney acknowledged that the notices from the paper and return receipts
were in order. Paul Walters then proceeded to make the following findings:

1. That there are exceptional and extraordinary
circumstances or conditions applicable to the
property of the petitioners and to the intended
use that does not apply generally to the other
property or class of use in the same vicinity
and in the district in which it is located.
