That there is no evidence that either Tract 1 or Tract 2 was ever transferred <br /> <br />....... <br /> <br />thereafter. <br /> <br />4. That neither said tracts exist on the tax roles of Morgan County, and no taxes are <br /> <br />currently being assessed on said real estate; and, in fact, the records of the Auditor of Morgan <br /> <br />County indicate no ownership of either of the aforedescribed tracts. <br /> <br />5. That the Town of Mooresville has certain sanitary sewer lines which are located in <br /> <br />the area more particularly described in the attached Exhibit" A" which is attached hereto and <br /> <br />made a part hereof and further there is an attached Plat showing the location of the sanitary <br /> <br />sewer lines all of which are in existence and titles to both Tracts 1 and 2 shall be taken subject <br /> <br />to these sanitary sewer lines and a permanent easement for the Town of Mooresville to install, <br /> <br />inspect, repair, maintain, operate, replace, extend, renew and change size of, and remove any <br /> <br />prior underground sanitary sewer lines, including man holes and other appurtenance or support <br /> <br />apparatus as the Town of Mooresville or its assigns may from time to time hereinafter deem <br /> <br />reasonably necessary for the transportation of sewage on, under, and through the strip of ground <br /> <br />described in the attached Exhibit "A". Said easement shall allow the Town of Mooresville to <br /> <br />cut roots or remove any trees, shrubs or other obstructions within the easement herein described <br /> <br />and the Town ofMooresville shall be responsible for restoring the easement area to the condition <br /> <br />it was in prior to any work being performed. This easement shall apply to the successors and <br /> <br />assigns of the respective owners of the tracts of land awarded herein. It being the understanding <br /> <br />-' <br /> <br />of the parties hereto that the easement above described and conveyed is intended to prohibit the <br /> <br />longitudinal or parallel occupancy of said easement strip, and surfa~e or subsurface structures <br /> <br />for excavation, mining or blasting within the limits of said easement right-of-way without the <br />
