<br />ORDINANCE <br /> <br />'3 <br /> <br />,1996 <br /> <br />AN ORDINANCE REGULATING UTILITY POLES <br />IN THE PUBLIC RIGHT-OF-WAY <br /> <br />WHEREAS, the Town of Mooresville through its Town Council is responsible for the <br /> <br />regulation of the public health, safety and welfare of the general public within the Town of <br /> <br />MooresviIle; <br /> <br />WHEREAS, public utilities have the right to place service poles on the Town of <br /> <br />Mooresville's right-of-way pursuant to IC 8-1-2-5; <br /> <br />WHEREAS, due to the location of most utility poles to the public streets the general <br /> <br />public is in the near proximity of these poles through pedestrian traffic and vehicular traffic and <br /> <br />other modes of transportation; <br /> <br />WHEREAS, the placement of signage on these utility poles creates obstructions, <br /> <br />distractions to vehicular traffic, leaves dangerous nails and other posting devices on the poles <br /> <br />which present potential harm to the general public and the employees of the utilities; <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Civil Town of <br /> <br />Mooresville, Indiana the following Ordinance regulating the use of utility poles, as follows: <br /> <br />SECTION I <br /> <br />Si&ns Which Interfere with Official SiEms/Traffic Devices <br /> <br />A. No sign or sign structure shall be permitted which attempts or appears to attempt to <br /> <br />direct the movement of traffic or which interferes with or obstructs the view of, or can be <br /> <br />confused with, imitates, or resembles any official traffic sign, signal or devise. No rotating <br /> <br />beam, beacon or flashing illumination resembling any emergency light shall be used in <br /> <br />connection with any sign display. <br />
