9. ~hat there shall be no physical expansion of utilities or co~aunity <br /> <br /> facilities beyond the normal to the residential use of the property. <br /> <br />This was seconded by Warren Franklin and unanimously approved. <br /> <br /> The next item on the agenda was a petition for variance filed by Edwin A. <br />Swatts and Jean J. Swatts of 10 Dunn Drive to allow the contruction of an <br />attached garage size 24 feet by 24 feet with said garage having the side set back <br />to be reduced to 18 feet and the back yard set back to 22 feet. Present was <br />Judy Arterberry along with Mr. & Mrs. Swatts, Judy being the agent from Smith <br />Brothers Builders who they have contacted for the construction of said garage. <br />Notices were found to be in order and the Board reviewed the drawings and ask <br />certain questions of the Swatts as to joining property owners. <br /> <br /> There were no remonstrators present nor any questions sought from the floor. <br /> <br /> Warren Franklin then <br /> <br />Chairman Osehman then asked for a motion from the Board. <br />proceeded to make the following findings: <br /> <br /> 1. That there are exceptional and extraordinary <br /> circumstances or conditions applicable to the <br /> <br />property of the petitioners and to the intended <br /> <br />use that doem not apply generally to the other <br />property or class of use in the same vicinity <br />and in the district in which it is located. <br /> <br />That the variance is necessary for the preservation <br /> <br />and enjoyment of a substantial property right <br />possessed by other property in the same vicinity <br />and district if such variance was not granted. <br /> <br />That the granting of such variance will not be materially <br />detrimental to the public welfare or injurious to the <br /> <br /> <br />
