<br />I <br /> <br />ORDINANCE NO. ~-1986 <br />ABANDONED VEHICLE ORDINANCE <br /> <br />BE IT ORDAINED, by the Board of Trustees of the Civil Town of Mooresville, <br /> <br />Indiana, by the acts of the General Assembly of the State of Indiana, it is <br /> <br />hereby ORDERED and ORDAINED that: <br /> <br />HHEREAS, it is necessary to establish reasonable regulations for the <br /> <br />protection of the lives, health and property of the citizens of the Civil Town <br /> <br />of Nooresville, and to enforce compliance with such regulation; it is hereby <br /> <br />ORDERED and ORDAINED that an ordinance be adopted concerning abandoned vehicles <br /> <br />within the Civil Town of Mooresville. <br /> <br />SECTION I. <br /> <br />Be it hereby ordered that pursuant to Indiana Code 9-9-1.1-16 that the <br /> <br />Town of Mooresville shall establish an abandoned vehicle account and fund said <br /> <br />account with sufficient monies to carry out the purposes of this ordinance. <br /> <br />All proceeds from the sale of abandoned vehicles or parts that are sold <br /> <br />pursuant to this ordinance shall be deposited in the abandoned vehicle account <br /> <br />after proper allocation has been made for towing and storage charges. <br /> <br />All cos t <br /> <br />incurred by the Civil Town of Nooresville in administering this ordinance <br /> <br />shall be paid from the Abandoned Vehicle Account. All monies remaining in <br /> <br />the account at the end of the year remain in that account and do not revert to <br /> <br />the Cæneral Fund. <br /> <br />SECTION II. <br /> <br />Section 9-9-1.1-1 through 9-9-1,1-16 of the Indiana Code are hereby <br /> <br />incorporated by reference. <br /> <br />SECTION III. <br /> <br />Definitiions. Definitions are used in this ordinance lIabandoned vehicle" <br /> <br />means: a vehicle located on public property illegally; (2) a vehicle left <br /> <br />on public property continuously without being moved for three (3) days; (3) <br /> <br />a vehicle located on public property in such a manner as to constitute a <br /> <br />hazard or obstruction to the movement of pedestrian or vehicle traffic on a <br /> <br />public right of way; (4) a vehicle that has remained on private property without <br /> <br />the consent of the owner, or person in control of that property for more than <br /> <br />48 hours; (5) a vehicle from which there has been removed the engine, transmission, <br /> <br />or differential or that is otherwise partially dismantled or inoperable and left <br />
