MINUTES OF MOORES¥ILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met a specially called session <br />on Wednesday, the 28th day of September, 1983 at 7:00 o'clock P.M. at the <br />Mooresville Town Hall. Present were Board Members Steve Oschman, Paul Walters, <br />Wendell Thaler, and Warren Franklin. Also present was the Board's Attorney, <br />Timothy C. Currens. The meeting was called to order by Chairman Steve Oschman <br />and the minutes of the last meeting were approved by all members. There was <br />a determination of a quorum and the Board proceeded with the first item of <br />business on the agenda which was Case Number 5-1983, Bradley Adams. Mr. Adams <br />filed this petition on behalf of the property owner Hiroko Payne. The common <br />address of the property is 598 Indianapolis Road and the variance mequest <br />was for the set back from the back property line. Mr. Adams explained that <br />he was putting a mini-barn, size 12 x 16 feet, 7 feet from the back property <br />line and 6 feet behind his house. Mr. Adams presented a drawing of the <br />property and adjoining properties along with a sketch of where the construction <br />work was to take place. There were no remonstrators present. <br /> The Board discussed the request and examined the drawings provided. <br /> Additional questions were asked of Mr. Adams and the same were answered. <br /> Chairman Oschman then requested a motion from the Board. Wendell Thaler <br /> then proceeded to make the following findings: <br /> <br /> 1. That there are exceptional and extraordinary <br /> circumstances or conditions applicable to the <br /> property of the petitioners and to the intended <br /> use that does not apply generally to the other <br /> property or class of use in the same vicinity <br /> and in the district in which it is located. <br /> <br /> <br />
