<br />Part I of this Ordinance, regulating the maintenance, repair, cutting,
<br />
<br />
<br />construction, reconstruction or alteration of public streets, alleys
<br />
<br />
<br />curbs, sidewalks and other publicways within the Civil Town of Moores-
<br />
<br />
<br />ville, Indiana,
<br />
<br />
<br />Section 2
<br />
<br />
<br />In the event that any such utility shall fail to comply
<br />
<br />
<br />with the provisions of the above Sectionl of Part II of this Ordinance,
<br />
<br />
<br />permits as are provided for in Part I of this ordinance shall not be
<br />
<br />
<br />issued until compliance is had,
<br />
<br />
<br />Section 3
<br />
<br />
<br />Any person, business, corporation or other entity, other
<br />
<br />
<br />than public or private utilities, which shall make application for
<br />
<br />
<br />a permit to cut, construct, reconstruct or lay any pavement on any
<br />
<br />
<br />public street, alley, curb, sidewalk or other publicway, or to repair
<br />
<br />
<br />the same, or alter the same, shall be obligated to make application
<br />
<br />
<br />and to pay the stated permit fee of Twenty-Five Dollars ($25,00) along
<br />
<br />
<br />with the inspection fee of Twenty Dollars ($20.00), as is set forth
<br />
<br />
<br />in Part I of this ordinance. Such person, business, corporation or
<br />
<br />
<br />other entity shall also be obligated to file with the Clerk-Treasurer
<br />
<br />
<br />of the Civil Town of Mooresville, Indiana, a corporate surety bond
<br />
<br />
<br />in the principal sum of Two Thousand Five Hundred Dollars ($2,500,00),
<br />
<br />
<br />as assurance to the Board of Trustees that each of such person,
<br />
<br />
<br />business, corporation or other entity shall fully comply with the
<br />
<br />
<br />provisions of Part I of this Ordinance, as to construction, maintenance,
<br />
<br />
<br />repair, alterations, cutting of, construction or reconstruction of
<br />
<br />
<br />public streets and alleys within the Civil Town of Mooresville, Indiana.
<br />
<br />
<br />Section 4
<br />
<br />
<br />In the event any such person, business, corporation or other
<br />
<br />
<br />entity shall fail to comply with the posting of such surety bond in
<br />
<br />
<br />the principal sum of Two Thousand Five Hundred Dollars ($2,500,00), to
<br />
<br />
<br />assure compliance with Part I of this Ordinance, permits as are pro-
<br />
<br />
<br />vided for in Part I of this Ordinance, shall not be issued until
<br />
<br />
<br />compliance is had,
<br />
<br />
<br />Section 5
<br />
<br />
<br />The Board of Trustees of the Civil Town of Mooresville, does
<br />
<br />
<br />hereby delegate to the 1100resville Street Superintendent the power
<br />
