<br />and authority, upon written request being made by any person,
<br />
<br />business, corporation or other entity, to permit the issuance of a
<br />
<br />permit without the posting of a Two Thousand Five Hundred Dollar
<br />($2,500,00) surety bond in the event that such Street Superintendent
<br />
<br />shall determine that a sufficient cash bond can be posted to assure
<br />
<br />compliance with Part I of this Ordinance,
<br />
<br />Such cash bond as shall be determined and set by this
<br />Street Superintendent, shall be posted with the Clerk-Treasurer of
<br />the Civil Town of Mooresville, Indiana, The cash bond shall be re-
<br />
<br />tained by the Board of Trustees of the Civil Town of Mooresville,
<br />Indiana, until completion of the project by applicant,
<br />The permit applicant shall replace, and at all times keep,
<br />
<br />and leave the involved publicway, public street, public alley, curb
<br />
<br />or sidewalk or part of the same, in as good repair as it was before
<br />
<br />the permit was issued, After the completion of the project by appli-
<br />cant, but before any of the deposit shall be returned and refuned to
<br />the permit applicant, the Town shall deduct from said deposit, any
<br />
<br />amount which is necessary to compensate said town or any of its employ-
<br />
<br />ees or agents, for replacing the involved publicway, public street,
<br />
<br />public alley, curb or sidewalk, or part thereof, in as good repair
<br />
<br />as the same was before the permit was issued and the work completed
<br />
<br />by the permit applicant, The balance of said deposit, if any, shall
<br />thereafter be refunded to the permit applicant,
<br />
<br />Any ordinance or parts of ordinances in conflict with Part I
<br />
<br />or Part II of this Ordinance, are hereby repealed, and Ordinance
<br />
<br />No, 77-8 and Ordinance No. 61-1 and Ordinance No, II, 1972, are
<br />
<br />herein specifically repealed,
<br />Said Ordinance consisting of Part I and Part II, adopted
<br />
