MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />The Mooresville Board of Zoning Appeals met at a called meeting <br />on Tuesday, August 26, 1980, at 7:30 P.M. <br /> <br />The following Board Members were present: <br /> <br />Mr. Paul Walters <br />Mrs. Nan Kollmeyer <br />Mr. Warren Franklin <br />Mr. Steve Osch4~~ <br /> <br />Mr. David E. Lawson, the Board's attorney, was also present. <br /> <br />Mr. Walters called the meeting to order. <br />ing of September 25, 1979, November 13, <br />were read and approved. <br /> <br /> The minutes of the meet- <br />1979, and July 16, 1980, <br /> <br />Mr. Walters advised the Board that the meeting was called to act <br />upon a petition for variance filed by property owners Floyd H. and <br />Barbara R. Perry, husband and wife. The petition has been docketed <br />as Number 5-1980. <br /> <br />Mrs. Barbara R. Perry presented the request for the variance to <br />permit a music studio service and rental of books, gifts and sup- <br />plies on their premises at 11 Circle Drive, on the proposed use <br />being a music studio and book store. <br /> <br />After petitioners presented their case, certain parties appeared <br />in opposition. The Board heard testimony from Mr. Jerry Witt, <br />31 Circle Drive; Mr. Ray Wilcher, 20 Circle Drive; and Mr. Carl <br />McNeely, 41 Circle Drive. <br /> <br />A written petition, signed by property owners and dated August 20, <br />1980, was also submitted to the Board. Such petition in opposition <br />was offered into evidence and signed by property owners on Circle <br />Drive. <br /> <br />Thereafter, the Board took under consideration the requested vari- <br />ance. A motion was made by Mr. Steve Osc~nd seconded by Mrs. <br />Nan Kollmeyer, unanimously passed by the Board that the variance be <br />denied by reason of the fact that it would alter the land use <br />characteristics of the district, diminish the marketable value of <br />adjacent land and improvements, and cause or add to traffic con- <br />gestion in the area. <br /> <br />There being no further business to come before the Board, <br />motion duly made and seconded, the meeting was adjourned. <br /> <br />upon <br /> <br />Nan Kollmeyer,'Secretary <br /> <br /> <br />
