Lawson, the Board's attorney, was also present.

Mr. Walters called the meeting to order.
ing of September 25, 1979, November 13,
were read and approved.

The minutes of the meet-
1979, and July 16, 1980,

Mr. Walters advised the Board that the meeting was called to act
upon a petition for variance filed by property owners Floyd H. and
Barbara R. Perry, husband and wife. The petition has been docketed
as Number 5-1980.

Mrs. Barbara R. Perry presented the request for the variance to
permit a music studio service and rental of books, gifts and sup-
plies on their premises at 11 Circle Drive, on the proposed use
being a music studio and book store.

After petitioners presented their case, certain parties appeared
in opposition. The Board heard testimony from Mr. Jerry Witt,
31 Circle Drive; Mr. Ray Wilcher, 20 Circle Drive; and Mr. Carl
McNeely, 41 Circle Drive.

A written petition, signed by property owners and dated August 20,
1980, was also submitted to the Board. Such petition in opposition
was offered into evidence and signed by property owners on Circle
Drive.

Thereafter, the Board took under consideration the requested vari-
ance. A motion was made by Mr. Steve Osc~nd seconded by Mrs.
Nan Kollmeyer, unanimously passed by the Board that the variance be
denied by reason of the fact that it would alter the land use
characteristics of the district, diminish the marketable value of
adjacent land and improvements, and cause or add to traffic con-
gestion in the area.

There being no further business to come before the Board,
motion duly made and seconded, the meeting was adjourned.

upon

Nan Kollmeyer,'Secretary
