MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />The Mooresville Board of Zoning Appeals met at a called meeting <br />on Wednesday, July 16, 1980, at 7:30 p.m. The following Board Mem- <br />bers were present: <br /> <br />Mr. Paul Walters <br />Mrs. Nan Kollmeyer <br />Mr. Warren Franklin <br /> <br />Mr. David E. Lawson, the Board's attorney was also present. <br /> <br />Mr. Walters called the meeting to order. The minutes to the prior <br />meeting were not available and will be read at the next called <br />meeting of the Board. <br /> <br />Mr. Walters advised the Board that the meeting was called to act <br />upon a Petition for Variance, filed by Dennis Knierim, Sharon <br />Knierim, and Phillip Nicholson. <br /> <br />The petitioners were represented by their counsel, Mr. Tim Currens <br />of Mooresville, Indiana. The Board found the petition to be pro- <br />cedurably in order, although the return receipts for notification <br />to property owners were not available to the Board. Mr. Currens <br />indicated they had been filed with the Clerk-Treasurer, and all <br />return receipts had been received. <br /> <br />The variance which was requested was that of building an addition <br />across the property lines of Lots 36 and 37 in Hadley's Second <br />Addition of the Town of Mooresville. The two residents on the <br />two separate lots which would be adjoined by the addition, have <br />been used under "Non-conforming Use" provisions of the Mooresville <br />Zoning Regulations, as professional offices. The use of the pro- <br />perty will not be altered. <br /> <br />There were no interested persons appearing at the public hearing <br />either for or against the requested variance. Upon motion made by <br />Mrs. Nan Kollmeyer, seconded by Mr. Warren Franklin, and unanimously <br />passed by the Board, the variance was granted, With the findings <br />that: <br /> <br />1. There are exceptional and extraordinary circum- <br />stances or conditions applicable to the property of <br />the petitioners and to the intended use that does not <br />apply generally to the other property or class of <br />use in the same vacinity and in the district in <br />which it is located. <br /> <br /> <br />
