Delp, 70 Sunbury Drive <br />Mr. Benny Tinsley, 40 Maryville <br /> <br /> The remonstrators objected to the business entity being <br />in the residential neighborhood by reason of the fact that they <br />felt it would decrease the value of their property at this time <br />and in the event of sale; that it would increase the traffic on <br />the street wherein people would be coming to the residential home <br />for the classes or purchasing supplies at the Walker home and that <br />they had bought in this area for the purposes of establishing their <br />home and did not wish to have further encroachments for business <br />activities therein. <br /> <br /> After considering the evidence presented in the case, <br />a motion was made by Mr. Paul Walters that the Petition be denied, <br />and the variance not be granted, as there were no exceptional or <br />extraordinary circumstances or conditions applicable to the property <br />or to the intended use that do not apply generally to the other <br />property or class of use in the vicinity and district in which the <br />Walker home is located; that the granting of such variance would <br />materially be detrimental to the public welfare or injurious to <br />the property or improvements in the district in which the Walker <br />residence is located and that the granting of such variance would <br />alter the land use characteristics of the district in which the <br />Walker property is located and diminish the marketable value of <br />adjacent land and improvements and cause or add to traffic congestion <br />in the area. <br /> <br /> The motion was seconded by Mr. Ray House and such motion <br />was unanimously passed by all members present. <br /> <br /> The Board responded to two inquiries which were made by <br />property owners in Mooresville in regards to interpretation of <br />the zoning laws on setback lines. Final determination of these <br />questions would have to be answered by the Building Inspector and/or <br />Technical Committee of the Plan Commission. <br /> <br /> There being no further business to come before the Board, <br />upon motion duly made and seconded, the meeting was adjourned. <br /> <br />Steve Edwards, Chairman <br /> <br />Nan Kollmeyer <br /> <br />- 2 - <br /> <br /> <br />
