MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Board of Zoning Appeals for the Civil Town of Moores- <br />ville met at a called meeting on Tuesday, September 26, 1978, at <br />7:30 p.m. The following Board members were present: Mr. Ray <br />House, Mr. Paul Walters, Mr. Steve Edwards, and Mrs. Nan Kollmeyer. <br />The attorney for the Board, Mr. David E. Lawson, was also present. <br /> <br /> Steve Edwards, as Chairman of the Commission, called the <br />meeting to order. In the absence of an appointed secretary, Mrs. <br />Nan Kollmeyer was selected to act as acting secretary for the <br />meeting. <br /> <br /> Mr. Edwards advised the Board that the meeting was called <br />to act upon Petition No. 3, 1978, filed by petitioners Charles <br />Ray Bain and Virginia Catherine Bain, husband and wife, at 54 <br />West Washington Street, Mooresville, Indiana. <br /> <br /> Mr. Lawson, as attorney for the Board, indicated that the <br />Petition appeared to be an order to be acted upon as publication <br />had been made and notice give~ to adjoining property owners. <br />There were no persons appearing in favor or against the Petition. <br /> <br /> Mr. Charles Ray Bain presented evidence on the Petition <br />asking that the variance be permitted for a wood working shop <br />in a one story building at the rear of his property at 54 West <br />Washington Street. In previous years this building had been <br />used as a printing shop. Mr. Bain indicated that the wood shop <br />would be operated during the day and would not involve any heavy <br />equipment. <br /> <br /> After considering the evidence presented in the case, a <br />motion was made by Mr. Ray House, and seconded by Mr. Paul Walters <br />that the variance be granted which motion was unanimously approved <br />by all members present. <br /> <br /> Mr. Lawson advised the Board that Mrs. Carl Walker had call- <br />ed inquiring as to whether or not she could continue to sell items <br />out of her residential home at her property at 630 Maple Lane, <br />Mooresville, Indiana, thru the Christmas holiday period. This is <br />the matter that was heard last month and the Petition for variance <br />had been denied. <br /> <br /> Mr. Lawson read to the Board the response that was made to <br />Mr. and Mrs. Carl Walker indicating to them there was no provision <br />for them to continue the operation of their business and legally <br />they had exhausted their remedies except for appealing the action <br />of the Board of Zoning Appeals and dening their Petition to a Court <br />of law in Morgan County. <br /> <br /> <br />
